my question is:
if I choose to do an upgrade to xp from the internet,MS
site, can I just do the upgrade without having to worry
about all my data on this computer. is my data safe and
will it work perfectly after the upgrade download.

Hi,
1) You should not download any versions of Windows.
2) If you are able to find a copy of Windows for download, unless it is from
MSDN it is illegal.
3) Never, ever install over the 'net unless you cannot avoid it (and even
then be cautious). Download, scan with your AV software, then decide whether
to install it.

You cannot upgrade to XP by downloading it - that is called piracy and
piracy is wrong - it's stealing. Suggest you purchase it legally.

There is no Microsoft site that permits you to do an upgrade to
XP. The upgrade to XP is a commercial CD, for sale, and is not
legally available for download anywhere.

Assuming that you buy and install a legal copy of the upgrade,
you have a reasonable expectation that it will go well and that
nothing will happen to your data. However, there are no
guarantees, and although unlikely, it's always possible that
something can go wrong and your data is damaged or even
completely lost. For that reason, it's always prudent to make
sure you have a reliable backup of anything you can't afford to
lose before taking *any* big step (and an upgrade of an operating
system is a big step).
