OK, it's not Windows but it's Office.
What's the legal position on this? It's apparently Unregistered or Activated
and has a genuine product key.

Greetings --

Does the purchase include the computer on which the Office Suite
has been installed? In not, I don't believe it can be sold within the
terms of its EULA. While an OEM operating system can be sold with
nearly any piece of hardware, I've never seen an OEM Office EULA that
permitted this. Ask the seller to mail you a certified (by a notary
public) copy of the EULA stating that this sale is in accordance with
the license.

Your taking a large chance when you do. First off they could off already
install it or made a backup copy and used the product key. if so, you can't
install and activate it. if that happens you MUST buy another copy. also
OEM software is ONLY to be sold with hardware.
