I have a Sony Vaio system that came with the OEM version
of XP operating system (Home edition). Much to my dismay
after having a major crash and losing everything, the OEM
version does not have a back up function in the software.
This was confirmed by Sony. If the Operating system was
an original version of XP Home it is contained on the CD
but does not load automatically (Per Microsoft). Is there
anyway just to get the file I need without buying an
upgrade?

No. If the OEM does not provide the extra tools that come with Windows
you will have to buy an original Windows CD to get them (or use
third-party replacements).

No. If the OEM does not provide the extra tools that come with Windows
you will have to buy an original Windows CD to get them (or use
third-party replacements).

available hedge against another disaster:

The predicament Sony and MS have put you in makes no sense. Did you mean
that you didn't even get an OEM XP CD from Sony or that the Sony CD did not
include Backup?
If Sony was constrained (by MS) from distributing Backup, and your OEM
license restricts your pre-installed XP to your Sony machine, then the evil
empire has struck again!
