Is it legal to use Windows XP to run a pay-per-use kiosk?

Is it legal to use Windows XP to run a pay-per-use kiosk?
This kiosk would provide no access to WindowsXP, but would
be using it to run the kiosk application. Users would pay
$X to use the kiosk for a certain amount of time.

I dont see why it would be illegal. Several coffee shops/corner stores rent
online time using XP.

Well, the closest that the EULA gets to this is:
"No Rental. You may not rent, lease, lend or provide
commercial hosting services to third parties with the
Product. "
but this is not rental of the software. We intend to make
money off of our kiosk application, not XP. Our users
cannot access XP or copy it from the kiosk.

Not very likely - the only way to avoid liability would
be to get something from MS saying it's OK. They may
well say OK, but if they have to "catch you", they
won't be so pleasant.
