If I buy an upgrade version and my system crashes can I
reload xp? My ME is not a hard copy it is on a partition?

It is just my opinion but, I would recommend buying the full retail version
of XP. If, no,..when your HD fails, you will wish you had the full version.

If you have an old Windows 98 CD, for a system that you're no longer using,
it will work just as well for proof of eligibility when installing the
Windows XP Upgrade. When the Windows XP Upgrade install says it can't find
a previous version, you swap the Windows XP Upgrade CD for the old Windows
98 CD, and give the path to that CD. After Upgrade eligibility is accepted,
you swap back to the Windows XP Upgrade CD and continue the install.

Provided you retain that partition you can reload the ME and from that
reload the XP. But I think you can also approach it this way, provided
the XP still runs. Run the CD from the existing system. Enter Install,
change Upgrade to New Install, then when it asks you to confirm where,
you can hit ESC and get the chance to select the current partition,
delete it, and create a new RAW one, going on to format it as part of
the setup
I think that this will also have detected that it was a legitimate
upgrade, and not even ask for the further evidence, but am not certain
on that
